US courts dismissed an antitrust lawsuit<\/a> that alleged prominent investors and individuals schemed to hijack the Bitcoin Cash<\/a> network, the world\u2019s thirteenth largest crypto network by market cap.<\/p>\n

A controversy around Bitcoin Cash<\/h2>\n

The complaint, amended in March 2020 and filed by crypto company United American Corp (UAC), named Bitcoin Cash proponent Roger Ver<\/a>, crypto exchange Kraken founder Jesse Powell<\/a>, BTC mining giant Bitmain and CEO Jihan Wu<\/a>, and Bitcoin Cash developers Shammah Chancellor and Jason Cox as the alleged participants in the scheme.<\/p>\n

UAC first brought its suit in December 2018 and alleging the named individuals had effectively manipulated and devalued Bitcoin and pushed the firm out of the network after it had invested over $4 million.<\/p>\n

The complaint also said that the individuals colluded and schemed to take over and centralize the Bitcoin market \u2018in violation of accepted standards and protocols in place since its inception.\u2019<\/p>\n

However, U.S. Magistrate Judge Chris McAliley of the Southern District of Florida said the case was not based on sound evidence and threw out the allegations of possible manipulation. He added the complaint \u2018must state facts \u2014 not conclusions \u2014 that plausibly suggest a conspiracy\u2019 for it to stay afloat.<\/p>\n

“The complaint is filled with factual assertions, although on closer inspection many really are conclusions that beg for specific facts to give them meaning. Moreover, many factual assertions, while interesting, do not clearly support the necessary essential elements of the claims,” the judge wrote.<\/p>\n

Zero ground<\/h2>\n

Judge McAliley said UAC had failed to expressly allege that all of the defendants entered into an agreement in violation of the Sherman Act, much less stated the terms of that agreement. He further both allegations mentioned in the complaint were \u2018incomplete and conclusory.\u2019<\/p>\n

Meanwhile, it was the final nail for UAC, which was earlier told by this hearing was its \u2018final opportunity\u2019 to plead its causes of action. The court had ealier dismissed the initial complaint for lack of personal jurisdiction and failure to state a claim.<\/p>\n

And now with the revised complaint dismissed, Judge McAliley said it was \u2018clear that it would be futile to give UAC another chance.\u2019<\/p>\n","protected":false},"excerpt":{"rendered":"
