{"id":320647,"date":"2023-04-26T10:35:40","date_gmt":"2023-04-26T09:35:40","guid":{"rendered":"https:\/\/cryptoslate.com\/?p=320647"},"modified":"2023-07-16T02:29:53","modified_gmt":"2023-07-16T01:29:53","slug":"what-changed-2018-video-reveals-sec-chair-genslers-contradictory-view-on-crypto","status":"publish","type":"post","link":"https:\/\/cryptoslate.com\/what-changed-2018-video-reveals-sec-chair-genslers-contradictory-view-on-crypto\/","title":{"rendered":"What changed? 2018 video reveals SEC Chair Gensler&#8217;s contradictory view on crypto"},"content":{"rendered":"<p>A video of Gary Gensler has emerged stating that most crypto assets are not securities.<\/p>\n<p>The <a href=\"https:\/\/twitter.com\/ZK_shark\/status\/1650689125580668931\">video<\/a> dates back to 2018 when Gensler was a professor at the Massachusetts Institute of Technology (MIT) teaching a course called &#8220;<a href=\"https:\/\/ocw.mit.edu\/courses\/15-s12-blockchain-and-money-fall-2018\/resources\/session-1-introduction\/\">Blockchain and Money<\/a>.&#8221;<\/p>\n<p>As the current SEC Chair, the crypto community has widely criticized his approach to digital asset regulation.<\/p>\n<div class=\"flex flex-grow flex-col gap-3\">\n<div class=\"min-h-[20px] flex flex-col items-start gap-4 whitespace-pre-wrap break-words\">\n<div class=\"markdown prose w-full break-words dark:prose-invert light\">\n<p><a href=\"https:\/\/cryptoslate.com\/us-congressman-emmer-says-sec-chair-gensler-is-incompetent\/\">Congressman Emmer<\/a> labeled Gensler, an &#8220;incompetent cop on the beat&#8221; for his enforcement actions. Emmer pointed out that Gensler had punished crypto firms for non-compliance \u2014 despite failing to provide clear guidelines for them to follow.<\/p>\n<p>Similarly, <a href=\"https:\/\/twitter.com\/twobitidiot\/status\/1648355229006729216\">Ryan Selkis<\/a>, the founder of Messari, criticized Gensler's proposed solution of meeting with the SEC and registering \u2014 saying it isn't possible to register with the agency.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<blockquote><p>&#8220;<span class=\"css-901oao css-16my406 r-poiln3 r-bcqeeo r-qvutc0\">The SEC has *never* issued comprehensive guidance about *how* to register. Only one firm who has gone in is still operating in the US in a meaningful way.<\/span>&#8220;<\/p><\/blockquote>\n<h2>Why backtrack?<\/h2>\n<p>During the Blockchain and Money lecture, Gensler said that \u2014 according to the definitions set out in the Howey test or similar tests in other jurisdictions \u2014 75% of cryptocurrencies in the U.S. and many other markets do not qualify as securities<\/p>\n<blockquote><p>&#8220;<span class=\"css-901oao css-16my406 r-poiln3 r-bcqeeo r-qvutc0\">3\/4 of the market is non-securities. It's just a commodity, a cash crypto<\/span>.&#8221;<\/p><\/blockquote>\n<p>The Howey test determines if a transaction qualifies as an &#8220;investment contract&#8221; and, therefore, a security. The test establishes whether a contract exists in which money is invested with an expectation of profit derived from the work of others.<\/p>\n<p>Before a Senate Banking Committee in September 2022, <a href=\"https:\/\/cryptoslate.com\/sec-chair-gensler-reiterates-that-most-crypto-are-securities-before-us-banking-committee\/\">Gensler<\/a> testified that most cryptocurrencies meet the definition of a security under the Howey test.<\/p>\n<p>Commenting on Gensler's opposing stances over time, ShapeShift founder <a href=\"https:\/\/twitter.com\/ErikVoorhees\/status\/1650971841622855692\">Erik Voorhees<\/a> asked, &#8220;<span class=\"css-901oao css-16my406 r-poiln3 r-bcqeeo r-qvutc0\">When does someone get arrested for fraud?<\/span>&#8221;<\/p>\n<p>Chiming in, the CEO of Tierion, <span class=\"css-901oao css-16my406 css-1hf3ou5 r-poiln3 r-bcqeeo r-qvutc0\"><span class=\"css-901oao css-16my406 r-poiln3 r-bcqeeo r-qvutc0\"><a href=\"https:\/\/twitter.com\/WayneVaughan\/status\/1650951646472466439\">Wayne Vaughan<\/a>, asked, &#8220;What changed?&#8221;<br \/>\n<\/span><\/span><\/p>\n<h2>The U.S. crypto industry is &#8220;dead&#8221;<\/h2>\n<p>In a recent interview, tech billionaire <a href=\"https:\/\/cryptoslate.com\/chamath-palihapitiya-hostile-us-regulators-have-guns-pointed-firmly-at-crypto\/\">Chamath Palihapitiya<\/a> said U.S. regulators had their guns firmly pointed at crypto.<\/p>\n<p>Considering the recent regulatory developments, he concluded that there is an ongoing, deliberate attempt to outlaw the U.S. crypto industry \u2014 effectively banning it and forcing the industry to move offshore.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A video of Gary Gensler has emerged stating that most crypto assets are not securities.
