{"id":335216,"date":"2023-06-17T04:12:12","date_gmt":"2023-06-17T03:12:12","guid":{"rendered":"https:\/\/cryptoslate.com\/?p=335216"},"modified":"2023-06-30T22:33:35","modified_gmt":"2023-06-30T21:33:35","slug":"bitwise-refiles-for-bitcoin-spot-etf-following-blackrock","status":"publish","type":"post","link":"https:\/\/cryptoslate.com\/bitwise-refiles-for-bitcoin-spot-etf-following-blackrock\/","title":{"rendered":"Bitwise refiles for Bitcoin spot ETF following BlackRock"},"content":{"rendered":"<p>Bitwise Asset Management submitted a filing on <a href=\"https:\/\/www.nyse.com\/publicdocs\/nyse\/markets\/nyse-arca\/rule-filings\/filings\/2023\/SR-NYSEArca-2023-44.pdf\">June 16<\/a> for a proposed rule change that would accommodate its planned Bitcoin spot ETF.<\/p>\n<h2>Bitwise refiles for Bitcoin spot ETF<\/h2>\n<p>The U.S. Securities and Exchange Commission (SEC) rejected a previous Bitcoin spot ETF application from Bitwise in June 2022.<\/p>\n<p>At that time, the SEC said that Bitwise's ETF could not put in place an adequate surveillance-sharing, could not provide protection against market manipulation, and could not show that the relevant market was of significant size.<\/p>\n<p>However, the SEC said that future applications could potentially meet these criteria, and Bitwise attempted to show that this is the case in its latest filing.<\/p>\n<p>Also, in the new filing, BitWise said the SEC should approve, reject, or start other proceedings around its proposed rule change within 45 to 90 days.<\/p>\n<p>The application was published by the New York Stock Exchange (NYSE) but has not been processed by the SEC, meaning that the actual deadline is unclear.<\/p>\n<h2>Proposal follows BlackRock news<\/h2>\n<p>Bitwise's latest filing follows a June 15 Bitcoin spot ETF filing from the asset management giant <a href=\"https:\/\/cryptoslate.com\/blackrock-files-for-spot-bitcoin-etf-coinbase-to-serve-as-custodian-for-btc-holdings\/\">BlackRock<\/a>. That application has prompted optimism due to the fact that the SEC has <a href=\"https:\/\/cryptoslate.com\/insights\/the-sec-has-only-once-rejected-an-etf-application-from-blackrock\/\">rarely rejected<\/a> BlackRock's ETF applications, though some experts suggest that the application is <a href=\"https:\/\/cryptoslate.com\/blackrock-spot-bitcoin-etf-not-happening-application-politically-motivated-says-noelle-acheson\/\">unlikely to succeed<\/a>.<\/p>\n<p>The U.S. SEC has not yet approved a Bitcoin spot ETF and has rejected numerous other applicants within the cryptocurrency and financial industry.<\/p>\n<p>Bitwise CEO Matthew Hougan <a href=\"https:\/\/cryptoslate.com\/bitwise-cio-sees-no-path-forward-for-spot-bitcoin-etf\/\">acknowledged the situation<\/a> in March.
