{"id":405526,"date":"2024-03-19T20:00:45","date_gmt":"2024-03-19T20:00:45","guid":{"rendered":"https:\/\/cryptoslate.com\/?p=405526"},"modified":"2024-03-19T19:24:11","modified_gmt":"2024-03-19T19:24:11","slug":"bankrupt-genesis-agrees-to-21-million-sec-fine-over-defunct-gemini-earn-crypto-lending-violations","status":"publish","type":"post","link":"https:\/\/cryptoslate.com\/bankrupt-genesis-agrees-to-21-million-sec-fine-over-defunct-gemini-earn-crypto-lending-violations\/","title":{"rendered":"Bankrupt Genesis agrees to $21 million SEC fine over defunct Gemini Earn crypto lending violations"},"content":{"rendered":"<p>Bankrupt crypto lender <a href=\"https:\/\/cryptoslate.com\/companies\/genesis\/\">Genesis<\/a> Global has consented to a $21 million civil penalty tied to the now-defunct <a href=\"https:\/\/cryptoslate.com\/companies\/gemini\/\">Gemini<\/a> Earn lending initiative, according to a March 19 <a href=\"https:\/\/www.sec.gov\/news\/press-release\/2024-37\">statement<\/a> from the US SEC.<\/p>\n<p>Under the settlement terms, the SEC will not be paid the penalty until Genesis satisfies all bankruptcy claims, including those from Gemini Earn investors.<\/p>\n<p class=\"s3\">This resolution, initially <a href=\"https:\/\/cryptoslate.com\/genesis-agrees-to-settle-sec-lawsuit-for-21-million\/\">agreed upon in January,<\/a> marks a pivotal moment for Genesis, allowing it to pivot its focus toward its ongoing bankruptcy proceedings.<\/p>\n<h2>Securities law violations<\/h2>\n<p><a href=\"https:\/\/cryptoslate.com\/people\/gary-gensler\/\">Gary Gensler<\/a>, the SEC Chairman, said the failed investment program bypassed essential disclosure requirements designed to protect retail investors.<\/p>\n<p>He added:<\/p>\n<blockquote><p>&#8220;Today\u2019s settlement builds on previous actions to make clear to the marketplace and the investing public that crypto lending platforms and other intermediaries need to comply with our time-tested securities laws. Doing so best protects investors. It promotes trust in markets. It\u2019s not optional. It\u2019s the law.&#8221;<\/p><\/blockquote>\n<p>Gurbir S. Grewal, the Director of SEC's Division of Enforcement, furthered that Gemini Earn's collapse highlights &#8220;the unknown risks that investors are exposed to when market participants fail to comply with the federal securities laws.&#8221;<\/p>\n<p>Notably, the settlement is coming a few days after a US Court <a href=\"https:\/\/cryptoslate.com\/court-rejects-gemini-genesis-motion-to-dismiss-sec-case\/\">upheld<\/a> the SEC's argument that the lender and Gemini crypto exchange offered and sold securities via the Earn product under the Howey and Reves test.<\/p>\n<p>Thus, this fine signifies the conclusion of the SEC's lawsuit against the company.<\/p>\n<h2>Gemini Earn update<\/h2>\n<p>Last month, the Winklevoss twins-led crypto exchange Gemini <a href=\"https:\/\/cryptoslate.com\/gemini-strikes-deal-to-return-all-assets-in-kind-to-earn-users-instead-of-historic-dollar-equivalent\/\">assured<\/a> its Earn users that they would receive &#8220;100% of their digital assets back in kind&#8221;\u00a0following an in-principle agreement with bankrupt Genesis and other creditors of the failed lender.<\/p>\n<p>In addition, the exchange also <a href=\"https:\/\/cryptoslate.com\/gemini-agrees-to-return-1-1-billion-to-earn-customers-as-part-of-nydfs-settlement\/\">disclosed<\/a> a settlement agreement with the New York State Department of Financial Services (NYDFS).
