However, she raised concerns about\u00a0part of the allegations.<\/p>\n<h2>Distinction needed<\/h2>\n<p>According to Pham, the complaint suggests that fund shares held by investors can be a form of leveraged trading in their own right.<\/p>\n<p>She said this interpretation does not distinguish between investments in funds, which are usually considered a security under the SEC's jurisdiction, and the trading activities of a fund, which fall under the CFTC's jurisdiction.<\/p>\n<p>She emphasized the need for a distinction, writing:<\/p>\n<blockquote><p>&#8220;Owning shares is not the same thing as trading derivatives.&#8221;<\/p><\/blockquote>\n<p>Pham added that the CFTC's handling of the issue &#8220;may infringe upon the SEC's authority,&#8221; undermining investor protection laws and disrupting securities market foundations.<\/p>\n<p>Some commentators previously observed that the case names Bitcoin (<a href=\"https:\/\/cryptoslate.com\/coins\/bitcoin\/\">BTC<\/a>), Ethereum (<a href=\"https:\/\/cryptoslate.com\/coins\/ethereum\/\">ETH<\/a>), and Litecoin (<a href=\"https:\/\/cryptoslate.com\/coins\/litecoin\/\">LTC<\/a>) as commodities, potentially excluding those tokens from the SEC's jurisdiction. Pham's statements do not address this exact issue.<\/p>\n<h2>KuCoin charged this week<\/h2>\n<p>The CFTC filed civil charges against KuCoin and related companies on <a href=\"https:\/\/www.cftc.gov\/PressRoom\/PressReleases\/8884-24\">March 26<\/a> over allegations of operating an illegal digital asset derivatives exchange and, more broadly, violating the <span lang=\"EN\">Commodity Exchange Act (CEA) by failing to register with the CFTC<\/span>.<\/p>\n<p>The US Department of Justice also filed <a href=\"https:\/\/www.justice.gov\/usao-sdny\/pr\/prominent-global-cryptocurrency-exchange-kucoin-and-two-its-founders-criminally\">criminal charges<\/a> against KuCoin and two of its founders, including but not limited to alleged violations of anti-money laundering laws.<\/p>\n<p>KuCoin responded to charges by <a href=\"https:\/\/cryptoslate.com\/kucoin-assures-users-funds-are-safe-after-us-levies-criminal-charges\/\">assuring users<\/a> that funds would remain safe and by asserting that it complied with various local laws.
