{"id":419052,"date":"2024-05-15T02:31:23","date_gmt":"2024-05-15T01:31:23","guid":{"rendered":"https:\/\/cryptoslate.com\/?p=419052"},"modified":"2024-05-15T02:31:35","modified_gmt":"2024-05-15T01:31:35","slug":"oklahoma-signs-bill-into-law-protecting-crypto-spending-mining-and-self-custody","status":"publish","type":"post","link":"https:\/\/cryptoslate.com\/oklahoma-signs-bill-into-law-protecting-crypto-spending-mining-and-self-custody\/","title":{"rendered":"Oklahoma signs bill into law protecting crypto spending, mining, and self-custody"},"content":{"rendered":"<p>Oklahoma has signed into law a bill protecting crypto-related rights.<\/p>\n<p>The Oklahoma State Legislature website indicates Governor Kevin Stitt approved HB 3594 on <a href=\"http:\/\/www.oklegislature.gov\/BillInfo.aspx?Bill=hb3594&Session=2400\">May 13<\/a>.<\/p>\n<p>The bill comes into effect on Nov. 1.<\/p>\n<p>Under the new law, the Oklahoma state government cannot prohibit, restrict, or impair the use of crypto in purchases or the self-custody of crypto.<\/p>\n<p>Furthermore, state and local governments cannot impose additional taxes or other charges specifically targeted at crypto. Taxes on legal tender apply.<\/p>\n<h2>Mining and other protections<\/h2>\n<p>HB 3594 also protects home crypto mining and mining businesses by declaring it legal to participate in either type of mining in Oklahoma.<\/p>\n<p>The bill specifically ensures that businesses can operate crypto mining companies in areas zoned for industrial use. Political subdivisions can change the zoning of a mining business with the proper notice and comments, and mining firms can appeal the change in zoning.<\/p>\n<p>The bill also prevents political subdivisions from placing specific noise restrictions and other rules on crypto mining businesses, though general noise ordinances and data center requirements apply.<\/p>\n<p>The state's public utilities commission, The Oklahoma Corporation Commission, cannot create discriminatory rate schedules for mining companies.<\/p>\n<p>Oklahoma cannot require parties in engaged mining, staking, and variations to obtain a money transmitter license. Similarly, it cannot require those who operate a blockchain node to obtain a money transmitter license.<\/p>\n<h2>Industry support<\/h2>\n<p>The Oklahoma Bitcoin Association wrote:<\/p>\n<blockquote><p>&#8220;The law makes Oklahoma the FIRST State to codify the rights of its citizens to run a node, to mine, and to self-custody their Bitcoin.&#8221;<\/p><\/blockquote>\n<p>Satoshi Act Fund CEO and co-founder Dennis Porter commented on the bill, asserting that it addresses an &#8220;onslaught of attacks&#8221; on self-custody.<\/p>\n<p>Certain US states and regions, most recently Arkansas, have <a href=\"https:\/\/cryptoslate.com\/arkansas-governor-to-reportedly-sign-two-bills-regulating-crypto-mining-activities\/\">imposed restrictions<\/a> on crypto mining, sometimes citing noise pollution as a justification.<\/p>\n<p>Meanwhile, attempts at US-wide legislation, including Senator Elizabeth Warren's <a href=\"https:\/\/cryptoslate.com\/senator-warren-wants-to-extend-anti-money-laundering-rules-to-crypto-miners-and-validators\/\">Digital Asset Anti-Money Laundering Act<\/a>, aim to impose restrictions in similar areas.
