{"id":446381,"date":"2024-10-02T22:00:26","date_gmt":"2024-10-02T21:00:26","guid":{"rendered":"https:\/\/cryptoslate.com\/?p=446381"},"modified":"2024-10-02T21:40:11","modified_gmt":"2024-10-02T20:40:11","slug":"cftc-loses-appeal-as-us-court-greenlights-prediction-markets-involving-elections-in-kalshi-case","status":"publish","type":"post","link":"https:\/\/cryptoslate.com\/cftc-loses-appeal-as-us-court-greenlights-prediction-markets-involving-elections-in-kalshi-case\/","title":{"rendered":"CFTC loses appeal as US court greenlights prediction markets involving elections in Kalshi case"},"content":{"rendered":"<p>The United States Court of Appeals for the District of Columbia Circuit ruled that prediction markets that allow betting on US elections are legal.<\/p>\n<p>The decision came in an Oct. 2 <a href=\"https:\/\/www.courtlistener.com\/opinion\/10128675\/an-opinion-was-released-in-case-24-5205-kalshiex-llc-v-cftc\/?q=kalshi\">ruling<\/a> that rejected an appeal made by the US Commodity Futures Trading Commission (CFTC) urging the court to issue an administrative stay in a previous ruling against the regulator in its case versus prediction market Kalshi.<\/p>\n<p>The court determined that the CFTC failed to prove that the public would suffer irreparable injury from the offering of US elections-based contracts.<\/p>\n<p>Tarek Mansour, founder of US-based prediction market Kalshi, <a href=\"https:\/\/x.com\/mansourtarek_\/status\/1841485986271760709\">shared<\/a> on X:<\/p>\n<blockquote><p>\u201cUS presidential election markets are legal. Officially. Finally. Kalshi prevails.\u201d<\/p><\/blockquote>\n<p>As a result, Kalshi can now resume offering US election-related contracts. Nevertheless, a new motion for a stay can be renewed if &#8220;substantiating evidence arises,&#8221; the Circuit judges highlighted.<\/p>\n<p>The CFTC prohibited Kalshi from offering political-related contracts on its platform on Sept. 22, 2023, after the prediction market asked the regulator to list a contract based on which party would control the US Congress this year.<\/p>\n<p>Thus, the prediction market sued the CFTC, claiming that the regulator's prohibition was outside its authority. Judge Cobb then sided with Kalshi, leading to the motion for a stay.<\/p>\n<h2>A potential win for crypto platforms<\/h2>\n<p>US lawmakers <a href=\"https:\/\/cryptoslate.com\/us-legislators-call-for-cftc-crackdown-on-election-gambling-as-polymarket-betting-hits-aths\/\">urged<\/a> a CFTC crackdown on US elections prediction markets\u00a0<span style=\"box-sizing: border-box; margin: 0px; padding: 0px;\">in a letter to Chair\u00a0<a href=\"https:\/\/cryptoslate.com\/people\/rostin-behnam\/\">Rostin Behnam<\/a> on Aug. 5<\/span>.<\/p>\n<p>Among the eight legislators who signed the document were Senators <a href=\"https:\/\/cryptoslate.com\/people\/elizabeth-warren\/\">Elizabeth Warren<\/a> (D-MA), Chris Van Hollen (D-MD), and Sheldon Whitehouse (D-RI), along with Representatives Eleanor Holmes Norton (D-DC) and Jamie Raskin (D-MD).<\/p>\n<p>The document claimed that elections are not a for-profit enterprise and that enforcement action against the platforms offering these contracts would \u201crestore trust\u201d in the elections.<\/p>\n<p>On the other hand, Congressman Richie Torres <a href=\"https:\/\/cryptoslate.com\/lawmaker-calls-on-cftc-to-regulate-election-markets-as-polymarket-activity-falters-amid-uncertainty\/\">also addressed<\/a> a letter to CFTC Chairman Behnam asking for the regulation of prediction markets related to elections instead of the prohibition proposed by lawmakers in August.<\/p>\n<p>The recent legal win by Kalshi might favor crypto-native prediction markets, such as BET and <a href=\"https:\/\/cryptoslate.com\/companies\/polymarket\/\">Polymarket<\/a>, in case the CFTC decides to comply with the enforcement call.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The United States Court of Appeals for the District of Columbia Circuit ruled that prediction markets that allow betting on US elections are legal.
