{"id":484999,"date":"2025-06-13T00:24:58","date_gmt":"2025-06-12T23:24:58","guid":{"rendered":"https:\/\/cryptoslate.com\/?p=484999"},"modified":"2025-06-13T01:14:18","modified_gmt":"2025-06-13T00:14:18","slug":"sec-ripple-seek-to-end-multi-year-legal-dispute-with-amended-filing","status":"publish","type":"post","link":"https:\/\/cryptoslate.com\/sec-ripple-seek-to-end-multi-year-legal-dispute-with-amended-filing\/","title":{"rendered":"SEC, Ripple seek to end multi-year legal dispute with amended filing"},"content":{"rendered":"<p><a href=\"https:\/\/cryptoslate.com\/companies\/ripple\/\">Ripple<\/a> and the U.S. Securities and Exchange Commission have refiled a joint request asking a federal judge to dissolve a court-imposed injunction and approve a revised $50 million penalty settlement, aiming to conclude their <a href=\"https:\/\/cryptoslate.com\/as-the-ripple-sec-lawsuit-nears-resolution-the-end-is-finally-here-for-xrps-legal-woes\/\">years-long legal battle<\/a>.<\/p>\n<p>According to a June 12 <a href=\"https:\/\/x.com\/EleanorTerrett\/status\/1933265188406636845\">court filing<\/a>, the SEC and Ripple asked Judge Analisa Torres of the Southern District of New York to issue an indicative ruling on their joint motion to dissolve the injunction issued in a 2024 Final Judgment.<\/p>\n<p>The two parties proposed that <a href=\"https:\/\/cryptoslate.com\/ripple-agrees-to-pay-50m-fine-and-drop-cross-appeal-to-settle-sec-lawsuit\/\">$50 million be paid<\/a> to the SEC as a civil penalty, with the remaining $75 million returned to Ripple.<\/p>\n<p>If the court grants the indicative ruling, the SEC and Ripple intend to petition the U.S. Court of Appeals for the Second Circuit to remand the case for formal resolution in the district court.<\/p>\n<p>This effort follows the court\u2019s May 8 <a href=\"https:\/\/cryptoslate.com\/court-denies-sec-ripple-settlement-motion-after-finding-procedural-misstep\/\">decision denying a similar request<\/a> for failing to demonstrate \u201cexceptional circumstances\u201d under Rule 60(b) of the Federal Rules of Civil Procedure.<\/p>\n<h2>Settlement momentum builds<\/h2>\n<p>The case stems from a December 2020 lawsuit alleging Ripple violated federal securities laws by selling <a href=\"https:\/\/cryptoslate.com\/coins\/xrp\/\">XRP<\/a> as an unregistered security.<\/p>\n<p>After years of litigation, the court in July 2023 issued a summary judgment, ruling partially in favor of both parties. A final judgment in August 2024 enjoined Ripple and imposed a $125 million penalty, followed by a September 2024 order requiring Ripple to deposit 111% of that amount into escrow.<\/p>\n<p>However, the SEC subsequently filed an appeal against the final judgement, causing Ripple to file a cross-appeal. The saga eventually culminated in both the firm and regulator filing a <a href=\"https:\/\/cryptoslate.com\/sec-files-to-settle-lawsuit-with-ripple-execs-over-civil-penalty-dispute\/\">motion to settle the case<\/a> in May.<\/p>\n<p>The current motion reflects a broader effort to end all pending appeals and avoid further litigation.
