{"id":570868,"date":"2026-10-10T02:50:00","date_gmt":"2026-10-10T01:50:00","guid":{"rendered":"https:\/\/cryptoslate.com\/?p=570868"},"modified":"2026-10-09T19:24:44","modified_gmt":"2026-10-09T18:24:44","slug":"celsius-founder-faces-lifetime-ban-but-can-trade-his-own-crypto","status":"publish","type":"post","link":"https:\/\/cryptoslate.com\/celsius-founder-faces-lifetime-ban-but-can-trade-his-own-crypto\/","title":{"rendered":"Celsius founder faces lifetime ban, but can trade his own crypto"},"content":{"rendered":"<p><span style=\"box-sizing: border-box; margin: 0px; padding: 0px;\">Bankrupt crypto lender Celsius founder Alex Mashinsky has agreed to a permanent\u00a0<span style=\"box-sizing: border-box; margin: 0px; padding: 0px;\">ban from the securities, commodities, and crypto business under a\u00a0New York settlement announced on Oct. 9.<\/span><\/span><\/p>\n<p><span style=\"box-sizing: border-box; margin: 0px; padding: 0px;\"><span style=\"box-sizing: border-box; margin: 0px; padding: 0px;\"> The agreement also <a href=\"https:\/\/ag.ny.gov\/press-release\/2026\/attorney-general-james-bans-former-cryptocurrency-ceo-who-defrauded-investors\">sets conditional state payment obligations<\/a> of up to $35 million, without creating a new<\/span>\u00a0payout to Celsius creditors.<\/span><\/p>\n<p>The deal resolves New York\u2019s civil suit, filed in January 2023, and adds state obligations to a separate federal criminal case. Mashinsky is serving a 12-year prison sentence.<\/p>\n<h2>What the $35 million figure means<\/h2>\n<p>The first obligation is $25 million in damages to New York. Under paragraph 2 of the <a href=\"https:\/\/ag.ny.gov\/sites\/default\/files\/settlements-agreements\/new-york-v-alex-mashinsky-stipulation-2026.pdf\">annexed consent order<\/a>, that obligation is deemed satisfied by a qualifying $10 million payment to the US Department of Justice under paragraph 11 of his federal forfeiture order.<\/p>\n<p>DOJ payments made after May 20, 2025, may count dollar for dollar toward that $10 million. If the specified payment is not made, New York's Attorney General is due the entire $ 25 million.<\/p>\n<p>The second obligation is a separate $10 million monetary judgment payable to New York. Paragraph 3 says it is deemed satisfied by completion of Mashinsky\u2019s imprisonment under the federal judgment entered May 12, 2025, subject to express exceptions.<\/p>\n<p>Those exceptions cover a sentence overturned or reduced by a court, including through a Section 2255 challenge. The agreed restrictions cover securities and commodities businesses, including crypto, and roles such as broker, investment adviser, manager, officer and consultant. They also prohibit investment advice distributed for compensation or economic benefit.<\/p>\n<p>The terms retain an exception for <a href=\"https:\/\/cryptoslate.com\/people\/alex-mashinsky\/\">Mashinsky\u2019s<\/a> own personal purchases or sales.
