{"id":57732,"date":"2018-06-04T03:13:51","date_gmt":"2018-06-04T10:13:51","guid":{"rendered":"https:\/\/cryptoslate.com\/?p=57732"},"modified":"2019-11-25T04:24:35","modified_gmt":"2019-11-25T04:24:35","slug":"south-koreas-top-court-orders-confiscation-of-bitcoin-recognizes-cryptocurrency-as-assets","status":"publish","type":"post","link":"https:\/\/cryptoslate.com\/south-koreas-top-court-orders-confiscation-of-bitcoin-recognizes-cryptocurrency-as-assets\/","title":{"rendered":"South Korea&#8217;s Top Court Orders Confiscation of Bitcoin, Recognizes Cryptocurrency as Assets"},"content":{"rendered":"<p>Korea\u2019s premier court has overturned the law to seize 191 Bitcoin earned through the provision of child pornography, ending a lengthy battle over the legal status of cryptocurrency.<\/p>\n<p>Appealing a September 2017 <a href=\"https:\/\/www.ccn.com\/korean-court-rules-bitcoin-seizure-illegal-confiscation\/\">ruling<\/a> that deemed such confiscation to be illegal, the Supreme Court will see $2.3 million worth of BTC confiscated from a 33-year old surnamed Ahn \u2014 the proprietor of a child pornography website.<\/p>\n<p>Convicted in September 2017, Ahn and his Bitcoin cache have been the cause for months of debate \u2014 prosecutors\u00a0failed to <a href=\"http:\/\/www.koreaherald.com\/view.php?ud=20180130001005\">confiscate 216 BTC<\/a> from Ahn in April 2018. Exempting Bitcoin from such action, a lower court <a href=\"http:\/\/www.koreatimes.co.kr\/www\/news\/nation\/2018\/05\/488_249868.html\">dismissed<\/a> the confiscation on the basis BTC had no physical form.<\/p>\n<p>The Supreme Court, however, sees things differently. Citing Korean law, the nation\u2019s top court dismissed the \u2018intangibility\u2019 argument <a href=\"http:\/\/www.koreaherald.com\/view.php?ud=20180130001005\">explaining<\/a>:<\/p>\n<blockquote><p>&#8220;Korean law stipulates that a seizable hidden asset ranges from cash, deposits, stocks, and other forms of tangible and intangible objects holding standard value.&#8221;<\/p><\/blockquote>\n<p>The move marks the first expropriation of cryptocurrency in the East Asian nation \u2014 further highlighting their recognition of the asset\u2019s \u201cmeasurable value.\u201d The Supreme Court <a href=\"http:\/\/www.koreaherald.com\/view.php?ud=20180130001005\">stated<\/a>:<\/p>\n<blockquote><p>&#8220;Bitcoin is intangible and comes in the form of digitized files, but it is traded on an exchange and can be used to buy goods.
